Rapid City pays $300K to Dick & Jane's Super Spot to settle Lawsuit

RAPID CITY, S.D. — (02-23-21) — Adult Store in Rapid City scores a huge win as Rapid City agrees to pay $300K to settle a lawsuit brought forth by the Dick and Jane’s Super Spot.

The lawsuit brought by owners of the Dick & Jane’s Super Spot adult store four years ago after the Rapid City Council revoked the company’s permit to operate because of an ordinance.

Fortunately a judge ruled the ordinance was unconstitutional. Now the city has settled the lawsuit after the council revoked the adult store’s operating permit.

Four years ago the Rapid City Council had claimed the Karate studio was an educational facility and that the Dick & Jane’s Super Spot was violating an ordinance. However a local Circuit Court judge disagreed with the city council and ruled that their ordinance was unconstitutional.

Local KOTA News spoke with the owner of the Dick & Jane’s Super Spot adult store…”We are pleased the city was able to work with us and reach a settlement before going to trial,” said David Eliason, owner of Dick and Jane’s Super Spot. “The city attorney had advised them to approve the permit from the get-go even after the appeal.” said Eliason.

Councilmember Ritchie Nordstrom was among the members who voted against allowing the adult novelty shop to operate claiming that it was not suitable for young children at the karate studio to be subjected to being exposed to adult entertainment.

KOTA asked Councilmember Nordstrom what his opinion was over the settlement.

“It could have been worse. It could have gone to a jury trial, and who knows what is going to happen then.” said Nordstrom. “I want to say thank you to everyone who was involved in the settlements out of court because when it gets into a jury system, you never know which way it is going to go.” said Nordstrom.
