RAPID CITY, S.D. — Owner of the Dick and Jane’s Naughty Spot adult store is asking a Federal judge to overturn a Rapid City Council decision banning David Eliason from opening an adult store within city limits.

The city council voted in September to deny David Eliason owner of the Dick and Jane’s Naughty Spot, a conditional use permit to open another Dick and Jane’s Naughty Spot adult store because according to the city council, no locations complied with zoning requirements.

Eliason who has gone through this issue before especially when a federal judge ruled against the city of Sturgis back in 2013 when they attempted to force Eliason’s adult store out of its location at 1543 Lazelle St, is asking in the complaint filed in federal court for an injunction on the Rapid city council ruling, stating that it violates his constitutional rights.
